LCC Judicial Review - Day 1 update

Opening arguments heard - LCC concede unlawful decision
Wed 20th July:
- It was a full day, starting on time at 10.30 and finishing just after 4pm.
- The majority of the time was taken by the claimants' (our) barrister, Ian Wise QC speaking and outlining the details of the case and the particulars of the challenge points.
- The last half hour, LCC's barrister began the process of outlining their defence and he will continue tomorrow (Thursday 21st).
- The Judge is excellent. He seems very knowledgeable about community care issues and the relevant law. This is reassuring.
- Difficult to tell though from his questions, which way it's going - unfortunately it seems very 50/50 at the moment.
However......
In LCC's opening statement, they have conceded that the decision they made around Nov/Dec last year in which they made a distinction between personal and non personal care services (shopping cleaning etc), and a decision to no longer fund non personal care services was unlawful - they have since withdrawn the guidance they had issued to social workers on this matter - however we are not aware if they have apologised or told anyone else - so we need to publicise this fact.
